The Reconciliator under the Department of Cooperation, Government of Goa, has directed prominent builder M/s Kurtarkar Real Estates to pay Rs 19,74,716 in outstanding maintenance dues for 39 unsold units at the Kurtarkar Landmark complex in Gogol, Margao.
The order was passed by Reconciliator in favor of the Kurtarkar Landmark Cooperative Housing Maintenance Society Ltd.
The housing maintenance society, registered in September 2022 and comprising 207 total units across six blocks, filed the dispute application under the Goa Cooperative Societies Act. According to the society, the developer held 39 unsold units, 22 residential flats and 17 commercial shops, as of July 2023 but failed to pay monthly maintenance invoices issued from April 2024 onward, causing severe strain on the complex’s upkeep.
The builder contested the claim contending that the units were locked and vacant, arguing maintenance applies only once sold and occupied and as a partnership firm, they were not "members" of the society under the Act.
The Reconciliator rejected these arguments, citing provisions of the Goa Cooperative Societies Rules, which explicitly mandates that developers must contribute maintenance for unsold units. The authority emphasized that the law provides no exemption for vacant units, as maintenance funds essential common infrastructure, security, and structural safety that directly preserve the value of unsold properties. The authority also noted that appellate rulings have established statutory timelines as directory rather than mandatory to enable fair adjudication.
The Reconciliator has finally directed the developer to clear arrears of ₹19,74,716 within 30 days of the order and 18% annual interest and late fees apply to each unpaid invoice until realization.
