The Mapusa Additional Sessions Court has granted bail to two brothers, Sanjay Sahani and Omprakash Sahani, accused in connection with the death of a fellow construction worker, Amit Kumar, following an altercation at their rented residence in Colvale. Bail was granted upon furnishing a personal bond of ₹40,000 each, along with one local surety of an equal amount.
The court allowed the bail applications, observing that the alleged assault occurred on the spur of the moment and without premeditation, while also pointing out significant discrepancies in the evidence gathered during the investigation. According to the prosecution, the victim, Amit Kumar, a construction worker residing in a rented room owned by Avdut Halankar at Tar Waddo, Colvale, was involved in a verbal spat with Sanjay Sahani on January 19, 2026.
The victim stated in his initial complaint that, upon returning from work for lunch, he encountered an intoxicated Sanjay, who allegedly began shouting obscenities at him because he had returned home early. Sanjay allegedly summoned his brother, Omprakash Sahani, by phone, following which both brothers allegedly assaulted Amit Kumar with fist blows and repeated kicks to his chest and abdomen.
In its order granting bail to both accused, the court highlighted several factual inconsistencies and gaps in the investigation. The court noted that on January 20, 2026, a day after the incident, Amit Kumar visited a clinic, where the doctor told police that the victim had initially claimed that he had fallen from a wooden canoe. The following day, January 21, 2026, the victim returned to the clinic in a deteriorated condition, with low blood pressure and breathing difficulties.
The landlord then informed the doctor that the victim had allegedly been assaulted by his roommates. Recognising the case as a medico-legal case, the victim was subsequently transferred to PHC Colvale. The Hurt Certificate issued by PHC Colvale recorded “nil” external injuries. The victim was later shifted to Goa Medical College at Bambolim, where he succumbed to septicemia and shock following surgical intervention on February 19, 2026, nearly a month after the incident.
The court further observed that the incident arose out of a sudden quarrel and that the alleged assault was carried out using hands and feet, without any weapons, indicating an absence of premeditated intention to cause death.
